What is the difference between a PROVISIONAL and a UTILITY patent?
A provisional patent is an application, not an actual patent, that expires within 1 year and offers 'perceived' ownership. The provisional patent application offers the inventor a 1-year period to claim ‘patent pending’ while searching for a scenario where the actual patent can be funded or the invention can be deemed potentially profitable enough to warrant the cost of the full patent. A utility patent typically requires a large investment and, when published after an average period of 3-5 years, shows proof of 'actual ownership.’ The purpose of utility patent is used to claim mechanisms or systems as IP that if challenged, can be defended in the court room.
What is the difference between a saw horse and a mule?
